Private law only rules beneficial ownership between the citizens but not the cases of self-help (§§ 229, 859) except its enforcement in case of dispute.
Civil disputes are to be fought out in front of ordinary courts. The regulations being in force therefore are ruled by the civil proceeding law and put in the code of civil procedure.
However beneficial ownership and procedural law are mutually referenced, their fundamental conception does not exactly correspond.
For example the term "claim" has another meaning in the civil code than in the civil proceeding.
