DBSG: Bundesdatenschutzgesetz - German data protection act
The main task of a private detective is to provide information (i.e. personal data) about a third person either in correlation with a criminal procedure or to obtain evidence in civil or labour law differences.
For this reason it is important that the client (customer) provides evidence to the detective, according to the German data protection act and has a legitimate interest in investigations about a person, respectively that the employer balances between the employee’s correct performance of services and its personal rights.
The detective agency will only provide the client with the data collected.
The client alone is responsible for complying with the regulations of the German data protection act towards a third person.
