According to § 1 UWG, § 823 Abs. 1 BGB not requested fax or E-Mail advertising is not legal.

According to the regional court of Berlin, the unsolicited delivery of advertising and brochures by fax offend against § 1 UWG provided that the recipient does not agree to or if his agreement can be supposed under an existing business relationship.

The delivery of E-Mails without previous approval or in case a business relationship does not exist, are contrary to fair competition.

Sender of advertising mails cannot know, how a recipient picks up his mails for instance by expensive GSM or satellite link.

In general not requested mails are illegal if high cost may occur to the recipient as well as wasting of work time.

We will have to take legal action against each offend against above mentioned principles.
